Atomic VIP purchase program has been set up by Amer Sports France SAS, company registration number 06 501 275 (RCS Vienne - France), 80 rue Condorcet, 38090 Vaulx-Milieu, France, VAT number FR 24 062 501 275 which is an affiliated company of Atomic.

The Pro purchase program is available to employees, VIP, professionals complying with the conditions and criteria as defined by Atomic having purchased Atomic products on or after the 15th of September 2015 through the Program available at www.atomic.com

1. PARTICIPATION IN THE VIP PURCHASE PROGRAM

To benefit from this Program, you must join the Program by creating a PRO, VIP, or employee account. The rights of this account are tailored to your profile. Participation in the Program is free of charge.

2. TERMS OF USE FOR THE PROGRAM

Products offered through this Program are intended FOR PERSONAL USE ONLY. This Program is not intended for purchasing products for third parties or for reselling products. If you do so, you may be excluded from participating in this Program.

Participation in the Program allows you to purchase products from the Online Shop at special prices. These prices are strictly confidential and are offered to you based on your profile. They may not be copied or otherwise disclosed.

Your account has a limit, which is set by the access code sent to you. This limit determines the total value of the products you may order, the range of products available for purchase, and the quantity allowed per category. Your account expires one year after its creation or upon your departure from the company.

Once the maximum purchase amount or the expiry date has been reached, you may still purchase products in the Online Shop, but you will pay the standard retail price as listed in the Online Shop.

Only products that are in stock may be purchased in the Online Shop; pre-orders are not accepted.

Shipping costs, regardless of the order value, are:

• CAD 10 for standard shipping
• CAD 20 for express shipping

3. CHANGES, SUSPENSION, OR TERMINATION OF THE ATOMIC PRO PURCHASE PROGRAM

This Program is a benefit offered by Atomic. For this reason, Atomic reserves the right to change, suspend, or terminate the Program and its terms and conditions at any time, without notice and without compensation.

4. LIABILITY

Your Atomic account rights are personal and non-transferable. You alone are responsible for your rights and it is your obligation to keep your access credentials confidential and not disclose them to third parties.

Atomic accepts no liability for any unauthorized use of your account by third parties.

Reselling products purchased through this Program, or any other misuse of the Program, will result in the withdrawal of your access to the Program.

Atomic strives to ensure optimal use of the rights associated with this Program for you.

5. ACCEPTANCE OF THE TERMS AND CONDITIONS

These terms and conditions do not exclude any rights to which you are entitled by law, which are non-waivable, or which cannot be contractually restricted.
